Please agree to the terms and conditions before submitting the application. Agree Disagree Article 1: Application of terms and conditions These terms and conditions apply to all persons renting mobile phones and the attached accessories (hereinafter referred to as Customers and Phone Kit(s) respectively) from PuPuRu International Co., Ltd.(hereinafter referred to as gOur Companyh). Article 2: Acceptance of rental contract 1. Persons renting Phone Kit(s) from Our Company shall read and agree to these terms and conditions. A completed application requires that information be sent to Our Company a specific number days before the rental period starts. 2. Customers shall accept that even if they submit an application according to Article 2 1., Our Company may not be able to provide rental Phone Kit(s) due to such reasons as lack of stock etc. 3. The rental contract shall be followed by issuing a confirmation for the accepted application. 4. If Customers need to make any changes to the accepted application, notify our Company three (3) business days before the delivery date (if it is a non-business day, the last business day is applied). Changes less than three (3) days before the delivery date may not be accepted. Please note that it is possible to return to the Phone Kit(s) before the end of the rental period, but the rental fees for the remaining days will not be refunded. Article 3: Delivery and return of the phone kit The delivery and return of the Phone Kit shall be made and confirmed at the designated location. Our Company shall not be responsible for any delay in delivery due to unforeseen circumstances, even if the delivery cannot be made on the date the applicant requested. Article 4: Rental period and fees 1. The rental period is counted from the day when the Phone Kit is delivered to the day when the Phone Kit is returned. 2. The date of return is the day the Customer drops the Phone Kit(s) into a mailbox or at post office. In case Customers cannot return the rental item(s) on the final rental day, Our Company shall charge 1,050 Yen per day as a late charge. 3. The maximum rental period is 90 days. 4. Customers shall pay the rental fees and Japanese consumption tax in accordance with the rental rate set for each rental plan. Article 5: Extension of rental period In order to extend the rental period, Customers must notify our Company in advance. Article 6: Phone kit return 1. If the Customer cannot use the supplied envelope to return the Phone Kit or the payment slip on delivery due to loss or for any other reasons and such reasons are the fault of the Customer, the payment for the return shall be charged to the Customer. 2. The return day is the final rental day; however, envelopes postmarked within three (3) days before or after the final rental day may be accepted. 3. If the rental period is extended, 1,050 per day will be charged as a late charge regardless of whether or not the envelope is postmarked within the three-day grace period. Article 7: Cancellation of application If a Customer needs to cancel the application for a phone rental, notify Our Company immediately. Our Company shall charge 3,150 yen per phone and the delivery fee if the cancellation is within three (3) days of the designated delivery date (if it is a non-business day, the last business day is applied), Article 8: Payment Customers shall pay the rental fees by credit card as designated by the Customer (hereinafter referred to as gDesignated Credit Cardh) according to the terms and conditions of the company issuing the Designated Credit Card. If the credit card company does not approve the charges, Our Company may send a bill. The due date for bill payment (corporations only) shall be determined by Our Company. Article 9: Control of phone kit, and lost or damaged phone kit 1. Customers shall care for and use the rental Phone Kit(s) for its intended purpose according to the instructions provided by Our Company. 2. If the rental Phone Kit(s) is lost or damaged during the rental period, inform Our Company immediately. 3. In the case of Article 9 2.,the Customer shall pay the actual damages for the Phone Kit (50,000 yen at the maximum) unless such damage or loss is covered by insurance. Article 10: Prohibition 1. Customers shall not attach any other communication devices to their rental Phone Kit(s). Modifications or replacement of any parts of the Phone Kit(s) is prohibited. 2. Customers are not allowed to give, pawn, or rent their rental Phone Kit(s) to any third party nor shall Customers commit any act that violates Our Companyfs rights with regard to the Phone Kit(s). Article 11: Liability Customers shall agree that our Company shall not be responsible for any losses to Customers for failure of the Phone Kit(s) for the primary purposes (or any losses to contractors, Customers, or third parties from disconnected calls due to bad reception), irrespective of reasons. Customers shall agree to the provisions in the article before using the rental Phone Kit(s). Article 12: Cancellation of rental contract 1. Our Company may cancel any contracts without any notification of the following reasons and may terminate the phone line for the rental phone. * In the event Our Company finds that the applicant made false statements on the application forms * In the event the creditworthiness of the Customer significantly deteriorates or is lost * If the event of improper use of the rental phone such as use that disrupts public order and morals * If the Customer violates the Terms and Conditions 2. In case of cancellation as stated in Article 13 1., the Customer shall return the Phone Kit(s) immediately and compensate our Company for any loss or charges due caused by the cancellation. Article 13: The customer shall agree to the terms and conditions herein. Furthermore, the Customer agrees that any dispute arising with respect to these terms and conditions shall fall under the jurisdiction of the local district court in Nagoya as the court of first instance. Note: These terms and conditions shall be revised and enforced on December 27, 2005.
