About the definition
"Contract"
indicates the contract which shows a customer needs to consent this Use Agreement and The Cautions on use, and also needs to use application in a procedure we predetermined by the application deadline. Also, “Contract” means a contract which is about service between customer and us after we consent the application.
"Service"
refers to the PuPuRu rental plan service which accompanies the rental cell-phone which is offered by us.
"Rental period"
refers to the dates from “first date” until “final date” (on a date to date base) the customer decides.
"First date"
refers to the pick-up date of the rental cell-phone which the customer decides.
"Final date"
refers to the return date which the customer decides.
"Effective postmark date"
refers to the postmark on less than the 3rd days from the final date.
"Rental Fee"
refers to the charge (basic fee/ rental fee/ postage fee/ optional service fee (customer arbitrary) to set up by each plan.
"Return tool"
refers to the cash on delivery check of the envelope only for return of specification of us, and the specification contractor of us.

| Article 1:Terms and condition of application |
| These terms and conditions apply to all persons renting a cell-phone and the attached accessories (hereafter referred to as Customers and Phone Kit(s) respectively) from PuPuRu International Inc. (hereafter referred to as we or us). |

| Article 2: Conclusion of a rental contract |
| 1. |
The rental contract shall be followed by issuing a confirmation of the customer’s reservation. |
| 2. |
We may not be able to provide rental cell-phone kit(s) due to such reasons below.
・Lack of stock of specific phone model which the customer requested.
・ It has a possibility that a customer may break or break this contract. |

| Article 3: Delivery and return |
| 1. |
The delivery and return of the rental cell-phone shall be made and confirmed at the place of specify. We shall not be responsible for any delay in delivery due to unforeseen circumstances, even if the delivery can not be made on the date the application requested. |
| 2. |
A customer shall check the contents immediately after a rental cell phone receipt. When there is no contact within 48 hours after a receipt from a customer to our company, it is regarded as the customer received and passed in the normal state. |
| 3. |
A return tool shall use to return of the rental phone kit. However, when it cannot be used according to user negligence, such as loss of a return tool, or when returning by how to specify a user,it becomes return at a user burden. We do not do the cut of the mailing cost which our company defines in that case. |
| 4. |
The return which passes over an effective postmark day is delayed and pays the arrears by a postmark day. However, even if it is within an effective postmark date, customer needs to pay for the additional rental fee if customer used the rental cell-phone later than the final date. |
| 5. |
We may destroy the extra attached goods at the time of return without customer’s consent. |

| Article 4: Rental period |
| 1. |
The rental period will set by the customer’s choice. |
| 2. |
The maximum rental period is 90days. (It depends on plan) |
|
| |
| Article 5: Changing and extension of contract |
| 1. |
Customer needs to contact us 3 business days before of the pick-up date and approval of us shall be obtain when customer wishes to change the detail of the contract. |
| 2. |
In order to extend the rental period, customer needs to notify PuPuRu in advance and it needs to be before the final date of the rental period. In that case, customer needs to pay 525Yen for the extension commission and the charge for each plan. In addition, if customer continued using the rental cell-phone without approval of us, customer needs to pay the arrears. |
| 3. |
Some optional service will update automatically and added by the extended days which the customer wishes. |
| 4. |
It is possible to return the rental cell-phone earlier than the final date, but the rental fee for the remaining days will not be refunded. |

| Article 6: Cancellation |
| 1. |
Customer needs to contact us immediately to cancel the reservation. |
| 2. |
Customer who cancels the reservation within 3 business days from the pick-up date needs to pay 3,150Yen per a phone for the cancellation fee. In the case of picking up at the airport, airport commission earned is added. |
| 3. |
Cancellation after receipt the phone and after starting the rental period cannot be accepted. The total amount of rental charge is customer’s burden. |

| Article 7: Charge |
| 1. |
Customer shall pay the charge of a rental defined by each plan. |
| 2. |
The customer shall pay the following charges after return the rental cell-phone. The payment will be over more than 2 months depends on the plan.
・Telephone call/Packet fee used during the rental period.
・Telephone call/Packet fee used during out of the rental period.
・Additional rental fee.
・Late fee.
・Broken or lost fee according to Article 9 and 10.
・Any other additional service fee. |

Guarantee money may be kept depending on the contents of application. Moreover, when returning guaranteed money and there is a charge which the customer should pay based on the preceding clause, the above-mentioned charge shall be offset from guarantee money, and the balance shall be returned. |

I Issue of a telephone call specification cost an optional service fee. However, the inquiry about contents of a telephone call/Packet can not be accepted. |

| Article 8: Payment |
| 1. |
Customer shall pay the rental charge by credit card as designated by the customer (hereafter referred to as Designated Credit Card) according to the terms and conditions of the company issuing the Designated Credit Card. If the credit card company does not approve the charges, we may send a bill. |
| 2. |
The due date for bill payment (corporations only) shall be determined by us. |
| 3. |
In the payment by a bank transfer, a transfer commission is taken as the customer burden. |

| Article 9: Control of phone kit and lost or damage phone |
| 1. |
Customer shall care for and use the rental phone kit for its intended purpose according to the instructions provided by us. |
| 2. |
If the rental phone kit is lost or damaged during the rental period, inform us immediately. In this case, customer shall pay us the communication facility price in Table 1. |
| 3. |
The phone call/Packet fee by the third parties who arose on the occasions, such as a theft, shall have the duty of payment to the customer. |
| 4. |
Even if rental cell-phone carried out, such as theft, are discovered/ recovered after (after settling accounts with a specification card) issue of a bill from us, the rental cell-phone price shall not return. |

| Article 10: Insurance(optional service) |
| 1. |
Customer shall be arbitrary at the time of an application, and shall give the insurance optional service of us. |
| 2. |
The damage shall compensated to loss by submersion, defamation, and the theft of a rental cell-phone during the rental period, and the rental cell-phone price of Table 1 shall be compensated with the contents of Table 2. |
| 3. |
Customer shall submit the certificate of nearby police station issue to application of a theft to us. It can not be adapted if there is no presentation. |
| 4. |
Insurance compensates communication facility price and does not compensate the damage which the customer and the third party covered according to the theft. |
| 5. |
If customer wishes the additional subscription to an insurance optional service, or cancellation, we shall be notified of that even in before 3 business days of pick-up date, and consent shall be obtained. |
| 6. |
We do not pay a refund of the optional service charge, no matter nothing happened. |
| 7. |
An optional service fee is renewal of 30 days when a rental period is changed by extension, it becomes automatic renewal of day by day (30), and cancellation in the middle of use can not be performed. |

| Article 11:Prohibition |
| 1. |
Customer shall not attach any other rental cell-phone devices to the rental cell-phone kit. Modifications or replacement of any parts of the phone kit is prohibited. |
| 2. |
Customers are not allowed to give, pawn, or rent their rental phone kit to any third parties nor shall customers commit any act that violates our rights with regards to the phone kit. |

| Article 12: The treaty in which it does not collateralize |
Customer shall perform this contract after consent of the following matter.
| 1. |
A rental cell-phone number is used continuously, without changing a cell-phone number for every loan. |
| 2. |
A rental cell-phone may be monitored for radio. |
| 3. |
Even if it is in the cell-phone version map top service area, there is a place which can not talk over the phone and it may be unable to use for the sake of the communication enterprise’ of a spot convenience etc. |
| 4. |
Since a cell-phone contains breaking down, also under use usual for precision instruments, and an article of consumption, it may deteriorate. |
| 5. |
We undertake no responsibility about the damage which was produced in (1)-(4) above. Moreover, we do not compensate the damage caused by the ability of a customer to have not used a rental cell-phone etc. |

| Article 13: Cancellation of this contract |
| 1. |
If customer corresponds to either of the following matters, we shall not do notice notification but shall cancel this contract immediately. In this case, we shall perform telephone circuit stop disposal of a rental cell-phone.
1. If falsehood is in an application.
2. If customer’s credit card standing gets worse remarkably.
3. If this agreement is broken.
4. If the purpose of using a rental cell-phone is judged not to be suitable in the public order and standards of decency. |

If there is cancellation of the preceding clause, customer shall return a rental cell-phone immediately, and also shall pay all damage and the debt which were produced by cancellation. |

| Article 14: Changing of this agreement |
We can change without a preliminary announcement of this agreement and each plan rates, if necessity arises, In this case, customer shall follow the agreement after change. Moreover, it is well-known by updating and the other methods to the homepage of us in that case.

| Article 15: Applicable and jurisdiction |
| 1. |
This agreement’s applicable in Japanese law. |
| 2. |
Customer must agree with that any dispute arising with respect to these terms and conditions shall fall under the jurisdiction of Nagoya District Court into agreement jurisdictional court regardless of an amount in controversy, when the necessity for a lawsuit arises about this use agreement and this contract. |

| Note: This terms and conditions shall be devised and enforce on 2011/01/11 |
